GovCon FAQs
How much does DBA insurance cost?
DBA insurance is Workers’ Compensation for workers engaged in US government contracts outside the continental United States. DBA is required by primes, subcontractors, and any subordinate contractors that may be engaged on the contract in projects abroad. DBA insurance can cost $20.00 to $30.00 per $100.00 of payroll in high-risk areas.
Does my company need to insure overseas sub-contractors?
According to the Department of Labor, federal law requires all U.S. government contractors and subcontractors to secure Workers' compensation insurance for their employees working overseas.
Do our domestic policies cover our international exposures?
Domestic policies do not adequately address certain risks that contractors may face while traveling or working outside the country.
Can subcontractors negotiate insurance requirements with general contractors (GCs)?
The trend is for a GC (prime contractor) to transfer the cost of risk to subcontractors. There is an opportunity to negotiate with the prime and shift some liability back to the GC. The key is to do so early in the contract negotiations, which involves getting accurate costs from your broker to help with the negotiation.
How can we get CMCC certified?
The Department of Defense (DoD) began incorporating the requirement for Cybersecurity Maturity Model Certification (CMMC) compliance into its requests for information in September 2020. CMMC is now being phased into all DoD tenders until 2026 when all DoD vendors will be required to meet some level of CMMC compliance.
Organizations seeking certification must work with Authorized or Accredited C3PAOs (CMMC 3rd Party Assessment Organizations) listed on the CMMC-AB Marketplace website. The C3PAO and other market vendors, such as a Registered Provider Organization (RPO), will guide the organization through the certification process. Before scheduling a CMMC assessment, the CMMC-AB recommends conducting a self-assessment using the CMMC Assessment Guides.
The steps to CMMC certification at a specific level typically include:
- Determine the CMMC level your organization needs to bid on DoD contracts.
- Select a professional CMMC-AB Marketplace vendor to walk your organization through the process and conduct a pre-assessment. Typically, an RPO can assist with this. Any gaps discovered can be filled before the formal assessment process.
- Use the CMMC-AB Marketplace to find an accredited C3PAO.
- The C3PAO then guides your organization through an assessment process per the CMMC maturity level requirements that you have chosen.
- Using a Quality Auditor, the CMMC-AB reviews the C3PAO's assessment.
- You have 90 days to close any gaps discovered during the formal assessment.
- If the assessment meets the criteria for the selected CMMC level, the CMMC-AB will issue your company a CMMC certificate of compliance. This certificate is valid for three years.
